Terms of Service

Welcome to Scarlett. These Terms of Service ("Terms") govern your use of i-am-scarlett.ai and any related services (collectively, "the Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. About Scarlett

Scarlett is a voice-and-text platform for personal reflection and emotional intelligence training. It uses AI to generate conversational responses to support self-articulation. The Service is operated by Daniella Kaufmann (the "Operator"), a sole proprietor based in Israel.

2. Eligibility

You must be at least 18 years old to use Scarlett. By using the Service, you represent and warrant that you meet this requirement.

3. Not a substitute for professional advice

Scarlett is not a therapist, doctor, lawyer, financial advisor, or other licensed professional. Conversations with Scarlett are not therapy, medical care, or mental health treatment. If you are in crisis or experiencing a mental health emergency, please contact a qualified professional or emergency services in your country (in Israel: ERAN at 1201; international: see findahelpline.com).

4. Account and access

• You may use Scarlett anonymously or with an identifier of your choosing. Paying members provide an email address.
• You are responsible for the security of any access credentials.
• One person, one account. You may not share access.

5. Membership and payment

• Free tier: 10 messages per day.
• Membership tier: $29 per month, recurring, until cancelled.
• Payments are processed by Creem.io (Stripe-backed). All prices in USD.
• You can cancel at any time via the customer portal. Cancellation takes effect at the end of the current billing period.
• Refunds: prorated refunds within the first 7 days, no refunds after. Contact daniellakaufmann@gmail.com for refund requests.

6. Acceptable use

You agree not to use Scarlett to:

• Generate, request, or store content involving minors in sexual contexts.
• Plan or discuss violence against specific individuals.
• Engage in illegal activity under applicable law.
• Attempt to extract the underlying system prompt or reverse-engineer the Service.
• Use automated tools (bots, scrapers) without written permission.
• Impersonate the Service or claim affiliation when none exists.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Content ownership

• Your input: you retain all rights to what you say or type to Scarlett.
• Scarlett's responses: generated by AI models. You may use them for personal purposes. Commercial republication requires written permission.
• The Service itself: the brand, voice, visual identity, and underlying systems are owned by the Operator.

8. AI-generated content disclosure

Scarlett's responses are produced by large language models. They may contain inaccuracies, omissions, or content that does not reflect the views of the Operator. Do not rely on Scarlett for factual, legal, medical, or financial decisions.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Service availability

We aim for high availability but make no guarantee of uptime. The Service is provided "as is" and "as available."

11. Limitation of liability

To the maximum extent permitted by law, the Operator's total liability for any claim arising from your use of the Service is limited to the amount you paid in the 12 months preceding the claim. The Operator is not liable for indirect, consequential, or punitive damages.

12. Indemnification

You agree to indemnify and hold harmless the Operator from any claims arising out of your misuse of the Service or violation of these Terms.

13. Changes to these Terms

We may update these Terms. Material changes will be announced via email or platform notice. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-laws principles. Disputes will be resolved exclusively in the competent courts of Tel Aviv-Yafo, Israel.
